The Nephrology Unit of New Caledonia (hereinafter U2nc) attaches the utmost importance to the protection of personal data and the privacy of users and persons who access its website. The Personal Data Protection Policy (“Policy”) describes the types of personal data that U2nc and its subcontractors may process.
All operations on your personal data are carried out in compliance with the regulations in force and in particular Law No. 78-17 “Informatique et Libertés” of 6 January 1978 as amended and Regulation No. 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (“GDPR”) made applicable to New Caledonia.
The user of the site acknowledges having read and accepted the Policy. If he disagrees with his terms, he is free not to use the site and not to provide any personal data.
ARTICLE 1 – Définitions
“Personal data” – any information relating to a natural person identified or who can be identified, directly or indirectly, by reference to an identification number or to one or more elements specific to him.
“Processing of personal data” means any operation or set of operations carried out or not by automated means and applied to data, such as collection, recording, organisation, structuring, storage, adaptation or modification, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or interconnection, limitation, erasure or destruction;
“Controller” – the natural or legal person, public authority, agency or other body which, alone or jointly with others, collects and processes personal data;
“Recipients” – the natural or legal person, public authority, agency or other body that receives communication of personal data, whether or not it is a third party.
“Authorised third parties” – a natural or legal person, public authority, department or body, under the direct authority of the controller or processor, who are authorised to process the personal data.
ARTICLE 2 – Scope
The purpose of U2nc’s personal data protection policy is to inform data subjects about how U2nc collects and processes their personal data.
ARTICLE 3 – Identity of the controller
U2nc, represented by Jean-Michel Tivollier and Jean-François Cantin, collects personal data in its capacity as owner of the site.
ARTICLE 4 – Processing of personal data
A. Purposes
As part of the operation of the u2nc.nc site, U2nc collects data about you. These data are processed in accordance with the purposes provided for at the time of collection, namely:
The management of spontaneous applications;
The management of contact requests;
The development of statistics and measures of service attendance.
B. Data processed
When collecting the data, the User will be informed of the data to be filled in and of the optional ones. The data identified by an asterisk in the registration form are mandatory for the User to access the services.
In addition, U2nc may collect personal data for other purposes, taking care to obtain the prior consent of the persons concerned.
In particular, U2nc may collect the following data:
– Identity: surname, first names, telephone number (landline or mobile), e-mail address;
– Contact data: messages sent to the site via contact forms, correspondence sent via the site.
– Traffic statistics: IP address, cookies, for example, the pages consulted by the User, the date and time of the consultation (see the details concerning cookies below).
An asterisk will indicate the mandatory or optional nature of the data that the data subjects could enter in the collection forms. In the absence of filling in the areas with an asterisk, the User will not be able to access the services. In any case, U2nc undertakes to process the data collected in accordance with the regulations in force and in particular the “Informatique et Libertés” of 6 January 1978 as amended and Regulation No. 2016/679.
C. Recipients of the data collected
The personal data collected on this site are exclusively reserved for U2nc.
In the event that U2nc entrusts data processing activities to subcontractors, the latter will sufficiently guarantee the implementation of appropriate technical and organizational measures, in particular in terms of reliability and security measures.
D. Data transferred to public authorities and/or bodies
In accordance with the regulations in force, the data may be transmitted to the competent authorities on request and in particular to public bodies, exclusively to meet legal obligations, judicial officers, judicial officers and bodies responsible for carrying out the recovery of debts.
